MNA Analysis of BORN Proposed Regulations

MNA Analysis

BORN Proposed Regulations
244 CMR 8.00 Licensure Requirements

8.02 Definition of Terms

Candidate: "means an individual who has been determined eligible by the Board to write NCLEX."

Issue: "…Board or it's designee" has been omitted since the previous definition of this regulation. This change leaves the eligibly determinations solely to the Board, not another third party.

MNA Recommendation: This is an improvement. Accept the proposed language.

"8.03 Initial Licensure by Examination as a Professional Nurse and 8.04 Initial Licensure by Examination as a Practical Nurse"

Issue: Neither regulatory proposal contains language to outline that after successful passage of NCLEX the Board will issue a Valid License to the applicant.

MNA Recommendation: include the issuance of a valid license this in the regulation for both the Professional Nurse and Practical Nurse.
